These terms are an agreement between you and Nextvibe LLC-FZ, a company registered in Dubai, United Arab Emirates, operating Brandios at brandios.ai(“Brandios”, “we”, “us”). By creating an account or using Brandios you accept them. Questions: info@brandios.ai.
1. The service
Brandios creates a digital twin from a short reference clip you film of yourself, then generates videos, images, and written posts in your voice, and — with your authorization — publishes them to social accounts you connect (Facebook, Instagram, LinkedIn, X, TikTok, and others we may add) and reads your own posts and engagement metrics to improve your content plan. Approvals happen in the app or over WhatsApp if you opt in.
2. Eligibility and your account
You must be at least 18 and able to enter a binding contract. Keep your credentials secure — activity under your account is your responsibility. Business accounts confirm the person accepting these terms is authorized to bind the business.
3. Your authorization for us to act on your behalf
- By connecting a social account, you give Brandios a standing authorization to publish content to that account and to read your own posts and engagement data through the platform’s official API — only content you have approved, or content covered by the automatic-publishing rules you have switched on.
- You warrant that you own or administer every account you connect (for example, that you manage the Facebook Page or Instagram professional account).
- You can revoke this authorization at any time by disconnecting the account in Brandios or revoking access from the platform’s own settings. Revocation stops publishing and triggers deletion of that platform’s data as described in our Privacy Policy.
4. Your content and your twin
- You own your content. Your reference clip, your brand profile, and the content Brandios generates for you are yours. You grant us a limited license to host, process, and transform them solely to operate the service — including creating your twin and rendering videos with it — and to publish results to your accounts as you direct. This license ends when you delete the content or your account, except for copies the law requires us to keep.
- Twins are of you. You consent to us creating a digital likeness of your face and voice from your reference clip. You may only enroll a twin of yourself, or of another person whose documented consent you hold and can produce on request.
- You are the publisher. You are responsible for the content published to your accounts, including content you approved after AI generation. Review before you approve.
5. AI-generated content and disclosure
- Brandios output is AI-generated. It can be inaccurate, incomplete, or unsuitable — we do not guarantee accuracy, reach, engagement, or business results.
- Platforms and laws increasingly require synthetic media to be disclosed: Meta requires disclosure of photorealistic AI video and realistic audio, TikTok requires AI-generated content labels, and the EU AI Act requires AI-generated content to be identifiable. Where a platform supports it, Brandios marks twin videos as AI-generated, and you agree not to remove such labels or provenance metadata. Any additional disclosure duty the platform places on the poster remains yours.
- Platforms may label, downrank, or remove AI content under their own policies — that is outside our control.
6. Platform rules
When you use Brandios with a connected platform, you must also comply with that platform’s own terms and community rules — including the Meta Terms of Service, Instagram Terms of Use and Community Standards, the LinkedIn User Agreement and Professional Community Policies (and, for organization pages, the LinkedIn Pages Terms), the X Terms of Service, Rules, and automation rules, the TikTok Terms of Service, Community Guidelines, Music Usage Confirmation and — where applicable — Branded Content Policy, and, for Google sign-in, the Google Terms of Service. Depending on TikTok’s current review status of our integration, TikTok posts may arrive as private drafts you publish from inside the TikTok app. Platform APIs come with limits (for example Instagram’s cap on API-published posts per 24 hours) — scheduled publishing is best-effort and can fail, queue, or be delayed by the platform.
Brandios is an independent product of Nextvibe LLC-FZ. It is not affiliated with, endorsed, or sponsored by Meta, LinkedIn, X Corp., TikTok, Google, or any other platform, and nothing in these terms grants you rights in any platform’s services, marks, or data. Platforms can change or withdraw API access at any time; if that happens, related Brandios features may degrade or stop, and we may modify or suspend them without liability.
7. Acceptable use
You agree not to use Brandios to:
- impersonate any person or entity, or publish deceptive synthetic media of anyone — including twins of people who have not consented;
- spam: bulk unsolicited content, artificially inflated engagement, duplicate posting across accounts, or high-frequency automated posting;
- publish content that is unlawful, infringing, hateful, harassing, or that violates a connected platform’s rules;
- run political or social-issue advertising without the disclosures the platform requires;
- scrape platforms, circumvent API limits, reverse-engineer the service, or resell it without our written agreement.
We may remove content, pause publishing, or suspend accounts that put our users or our platform access at risk — including when a platform requires us to.
8. WhatsApp messages
If you opt in, we send approval requests and service updates to your WhatsApp number. Message and data rates may apply. Opt out any time in settings, by replying in the chat, or by emailing us.
9. Fees and billing
Paid plans bill in advance on a recurring basis at the prices shown at checkout, plus applicable taxes. You can cancel any time; cancellation stops future renewals and the plan runs to the end of the paid period. Except where the law says otherwise, fees are non-refundable. We may change prices with notice before your next renewal.
10. Intellectual property
Brandios — the software, models we build, designs, and brand — belongs to Nextvibe LLC-FZ. Feedback you send us may be used without obligation. Nothing in these terms transfers our IP to you, or your content ownership to us beyond the license in section 4.
11. Termination
You can close your account at any time. We may suspend or terminate accounts that breach these terms, create legal exposure, or endanger our platform access, with notice where practicable. On closure, your twin, reference clip, and platform data are deleted as described in the Privacy Policy.
12. Disclaimers and liability
Brandios is provided “as is” and “as available”. To the maximum extent the law allows, we disclaim implied warranties and are not liable for indirect, incidental, special, or consequential damages, lost profits, or lost data, nor for actions of connected platforms (including labeling, restriction, or suspension of your accounts). Our total liability for any claim is limited to the amounts you paid us in the 12 months before the event giving rise to it. Nothing here limits liability that cannot lawfully be limited.
13. Indemnity
You will indemnify Nextvibe LLC-FZ against claims, damages, and reasonable legal costs arising from your content, your breach of these terms, or your violation of a connected platform’s terms or of applicable law.
14. Governing law
These terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai, and disputes are subject to the exclusive jurisdiction of the courts of Dubai. If a clause is found unenforceable, the rest stays in force. Nothing in these terms limits mandatory rights that consumer-protection law grants you in your country of residence.
15. Changes to these terms
We may update these terms as the product and platform requirements evolve. For material changes we will notify you in the app or by email before they take effect; continued use after that means you accept the new terms.
